YAEbayT - Delivery Confirmation not scanned

So I sold a ps3 game on ebay and shipped it in a box and sent it media mail with delivery confirmation back on Feb 28. The item is still undelivered and the last delivery confirmation scan was on March 2nd. The buyer claims they never received the item. That I should contact the post office where it was last scanned (for what? so they can tell me that it was probably delivered and not scanned). Anyhow, there is no way of me knowing it was delivered or not delivered, DC is not tracking so the Post office wouldn't have a clue.

Has anyone been in this situation before?

I see it from the buyer's perspective that if I hadn't received something and DC shows a last scan on March 2nd, I should worry.

Buyer didn't pay insurance, I didn't include it. Do I just eat the cost or fight it?

Oh and the buyer has a long list of negative feedbacks left to sellers from not receiving items. I think I should just add them to my buyer ban list and issue a refund and be done with it.

Any suggestions are appreciated.

Why would you bother selling to someone with many negatives without informing them that insurance is a requirement?

Well it was buy-it-now, and I sell so much so often I don't bother checking their feedback left. Never ran into this before, but always heard about the DC not scanned scam. Wonder what Paypal/eBay's policy is on this.

As the seller, it's your responsibility to buy insurance. As it is, the shipment wasn't delivered, so you will have to eat the cost of the refund. If he files a paypal dispute, you will lose.

yeah that is what I figure as well, lame. Reading up on this it seems they can pull this kind of crap even when the item is delivered by stating that they never signed for the package. eeek
