if its acting up right now... tell the dealer and make sure they note the issue before the warranty period ends... it should allow you to get it replaced.
 
If its acting up get it replaced now. The tranmission doesn't need to be completely shot to be replaced. If its slipping you have valid reasons to demand a replacement before the warranty expires

Might very well be the transmission controller. Not sure if Toyota uses the ECU to control the tranny, or a BCM like DaimlerChyrsler, but it may not be the transmission at all.
