So this guy in a Red '89 Prelude pulls out in front of me when I'm going 40 and I hit him.

He tries to get me to take $40 and walk away. My hood is banged up and my headlight assembly for drivers side is gone.

Police finally come and get all the information. I have an insurance contact for him.

Police say it's obvious the wreck is his fault. They said I should take car to a dealer for estimate and then contact his company.

Going to a dealer for an estimate would probably put the damage at around $2000 or more. Once I get this estimate, will his company try to drive it down? Accident is clearly his fault. I have a lawyer on hand from some other issues. They're not going to be too stupid are they?

How high do you think I can get them to state the estimate? I know the Thunderbird can't be construed to have $50,000 in damage, and I'm not going to wear a neckbrace to court, but if they estimate on the high end, I can use the insurance money for something else right? I'm more interested in getting a new car than fixing the Thunderbird.

give that lawyer the case and go to a doctor immediately. You will be able to to get money to fix your car and for pain and suffering at 40 mph u should be able to get some money as u were going fast

You'll be fine...just go to a dealer, get an estimate, then go to an independent body shop and get another and call his insurance company's claim line and go from there. They may even have someplace to take your car for them to estimate, too, or send someone out.

Tell them you want it fixed at the dealership and fax them a copy of the estimate (or however they want to obtain a copy)

Yeah...and good point by Ylen...get thee to a Dr...maybe a chiropractor 1st for x-rays...good chance you have whiplash and may have scar tissue already forming in your neck/back. I've been in two wrecks and received whiplash in each and I have back/neck problems from them....sucks.

probably they will try to send you to somewhere that has a deal with them, but get it done at a dealer. best way to go.

see doctor, get multiple opinions from different body shops for the damage, and get a policy report

When they decide to agree with my numbers for the damage, will they cut the check to me or the repair place?

I would rather buy a different car than fix this one.

I elected not to have the repairs done and just drove it around as it was a 91 Corolla and kept the money

did the inspector from the insurance company come to your residence or did he come to the body shoop to inspect the damage?

The other company came out took pictures and stuff ( home ).... I took it to an independant body shop and had the estimates done and mailed them the quotes.

when i was in my accident i went to a triple a approved repair facility and no adjuster was needed (well none in my presence and it wasn't my fault anyways)

right but i assume they came out and inspect at your residence instead of at the body shoop correct??

as when we left one of our car at the bodyshoop for the inspector to come there the check was in both names another time it was not that big of accident so we didn't get a lawyer and he came out to our residence and it was in our name

edit:reread your post and see u said home so that is why it was in your name only!!!

Just got the estimate for damages.

It's supposed to be a total loss.

As long as this guy's insurance company is legit, I'm very very happy.

If you are an insured, the check will be made out to you and the bodyshop, or you and the financial institution who is holding the lien. The insurance company has an obligation to the lienholder to attempt to make sure the car gets fixed.

If you are a claimant, or a second party to the claim and are not at fault, the insurance company makes the check out directly to you.

It has nothing to do with where the car was inspected.

In this case, you are a claimant, the company has accepted liability, and they don't care if you get the car fixed or not. You have been made whole once they hand that check over to you and you accept it.

if the car is total lose u are getting the check on your name then. Still not sure if u are being represented by a lawyer or not. If not then talk to insurance company and see if they will let you keep the car.

Not sure if others have suggested - but I'd just tell my insurance company and let them worry about it. The way it works - they (your insurance co) pay for everything out of their own pocket and then go after the other guys insurance company.

that is only true if he has full side insurance. If he has liability only then he has to wait till that insurance company pays him

I called his insurance company.

They won't tell me if he's even covered until I get an accident report. They're not very friendly, their offices are ghetto.

They write policies for "Benchmark Insurance" and "Gateway".

I might just ask my lawyer to call them.

"Tell us if you're covering him or you can tell the judge when we sue you".

Also, like some lawyers on this board have mentioned when asking for legal advice, you should ask the mods to delete this thread just in the event you do go to court. You don't want to leave any evidence of this lying around.

call them and if they tell u the same thing ask to speak to supervisor. What if police was on on scene and there is no police report are they going to tell u sorry we can't give you this info. When you call say that i want to file a claim, one of the drivers that is cover by your insurance company hit me and they should take all of your info. If they refuse that speak to supervisor and he also refuse notifie them that AG of the state willl be contacting them soon and so will your lawyer
