YAB(ally's)T: I'm about to kill someone

So, just short of 3 years ago, I signed a 1-year contract at Bally's, not knowing what I was getting myself into. After the 1-year was up, I remember going in and signing supposedly what was just an acknowledgment that I was in a month-to-month plan. APPARENTLY, they took this to mean that I wanted to re-sign for 2-years. So of course, this pissed me off, but I couldn't do much about it, right? I'm patiently waiting and paying the $30/mo, and I call in today and find out that my contract somehow goes through July of NEXT year (2010)!!!

Anybody have any suggestions on what I can do? I know, "lawyer up", but that's a pretty generic thing to do. The bitch CSR on the phone says that Bally locations don't keep paperwork because they send them into the central office, so that's where all the contracts are. (convenient, eh?) If I want to dispute it, I have to send in my driver's license and 5 written signatures, whereupon their "writing specialist" will determine whether or not I signed a contract. Apparently I can't even get a copy of this thing beforehand. ALSO, if they find that I'm wrong, I have to pay the entire account in full at that point. Which, honestly, if that would actually cancel my contract, I might do it.

I have no advice, but I'd like to add that I've only heard horror stories about Bally's.

Maybe you should just take this as a sign to lose some weight off that fat ass and actually use the gym?

LOL...no idea where that came from. I'm 5'11", 170lb right now. Went to Lifetime Fitness for a few months after I moved to Phoenix last June, and now I go to Crossfit Southwest.

I assure you, I look much better than you do.

I did, and I had a copy a long time ago, before I found out I was being screwed. After having moved across the country, I have no freaking clue where it is now. I guess you'll just say that this is how I have to learn a lesson ;)

That definitely sucks. You mentioned that you've moved recently...is there a Bally's location relatively near where you currently live? If not, I believe there might be a stipulation in the contract that lets you cancel without an early termination fee. I remember reading something about it when I signed my contract, but I can't recall exactly what it said, as that was over 9 years ago.

They're everywhere, you have to be like 50 miles away from the nearest one and I live in Tempe, AZ. There's at least 3 within 5 miles.

I wish I were so lucky. Maybe I should find out how they qualify someone as having moved...maybe get some mail sent to the middle of the desert or something :D

How is it legal for them to refuse to send you a copy of the contract if you offer to pay for shipping?

Sorry to hear about this mess. Hope it works out.

edit: Why do you need your specific contract? Maybe they could just give you a blank copy to review.

Because I have no recollection of this contract that they speak of :p I want to see a copy of the contract, which I supposedly signed three times.

Tell them they can shove it if they won't send you a copy of the contract. "I didn't sign any contract that said I was extending till 2010. The paper work I signed was set to expire at 200(?) and I've never seen anything to the contrary. Either you show me the contract or I'm going to assume you're making it up." Either they send you the contract or it doesn't exist.
