YA(ebay)T: Any buyer protection for this item?

I bought a subwoofer from ebay a few days ago. Ebay auction listing From the listing he said it was tested and in working condition. Well it's not. The whole cone is pushed down and stuck. It does not move freely like a working speaker would so I'm assuming it's blown.

I've already emailed the seller about the problem. Since he said it was sold as is, do I have a case and possibly getting my money back?

Reel you in with the "tested and working", making you believe you are getting a good deal.
So you buy it and test it, and it "works", just doesn't work good or right!

Ah, yes, "Sold as is"!
(I got hooked like that a couple months ago, Video Card for a laptop. It worked, just very poorly! Would go "whacko" after it warmed up, exactly the same problem the other Video Card had.)
 
all you really can do is file a thing with paypall and ebay. shrug odds are you are screwed. make sure to leave a negitive on the last day

edit: hmm he does clearly say as is. but he lied in the description. who knows what paypall will do.


edit2: i see you had to get insurance. just file it under insuarance and get the money back.

I didn't answer your question at all, did I?
Someone with more experience with e-Bay can help you more than I, but I would bet the "sold as is" covers the seller.

Did you pay for it through a credit card?

The CC company may be more forgiving if its under a "Significantly less than described" clause. If you're a long time member of the CC company in good standing, they'll probably wave it off for you no ?'s asked.
