Our horribly complex legal code is the end result of millennia of weasels (and their lawyers) arguing that what they did was not technically illegal. EULAs and terms of use are the same, though based on a shorter period.
As long as military-school students argue they shouldn't be expelled because they were not specifically ordered not to cheat, and bad parents sue id because Doom made their kids kill, and people here ask if their business can share different parts of one copy of Office among employees, EULAs will be a fact of life.
