its just confusing causei have no idea if this is the newest and best version or not....and i dont have an action replay...wonder if there is a way around that.

You can mod an xbox in many different ways. Three that I can think of include flashing the bios on the motherboard (TSOP flash; requires soldering and either a TSOP programmer or some other temporarily-installed mod), installing a modchip to override/bypass/whatever the original bios (some required soldering, some don't), or softmodding. My personal Xbox was modded using a TSOP flash, although I tend to prefer softmodding these days. I have softmodded 5-10 xboxes and put larger hard drives in them. I find the 'hot swap' method to be easiest, although I have used the MechAssult/007AUF method as well. You will need to download a bunch of software tools from the usual place if you wish to go this route.

You should read all tutorials and info you can get your hands on before the mod, IMO. If you are new at it you can brick your xbox with a softmod pretty easily.

There is... I have used a USB flash drive and a modified cable (see here) as well as a hacked version of the action replay software.

Just for playing burned games, that's pretty much it at the moment aside from aesthetic mods. The 360 would be crazy powerful for an XBMC system, but the security is too tight on it.

I'm a little biased, as I am very experienced with a soldering iron, but you can get a $20 chip and install it very easily. You're going to open your Xbox anyway to install a larger drive (or you should), so soldering ONE small point and a few big ones took me maybe 5 minutes. It was literally faster than putting the system back together.

Once a chip is installed, all you have to do is put in Slayer's disc and boot the system. Done!

is the upscaling (dvd's to 720p/1080i) done by xbmc better or comparable to a upscaling dvd player? i am thinking of getting 1 for that purpose

I think it is comparable, but maybe not to the very high-end component scalers out there, or the various PC software based solutions.

However, for something you'd buy for $100 at a Wal-Mart, this is a better solution IMO.

ive doen all 3, soft mod is easy and best if you plan on just using XBMC and using network shares. TSOP if you are experienced and cheap, you can put a switch on it so that you can still go on live. mod chip, if you are not experience, know how to solder, and want games/xbox live/xbmc/multiple bioses/ or if you are scared you might screw up.

Sure, you can stick an 80mm fan in there with a little dremeling. You can go all kinds of crazy with an Xbox - mine has a black jewel, a nice American Cherry wood skin, blue LEDs around the eject button, an XERC chip for remote on/off, a 500gb hard drive, a quieter aftermarket fan, a 16x disc drive, and on and on and on. You can do a LOT of neat stuff with these machines :)

has/will XBMC ever be able to stream live tv like MCE extender? until then its still weak imo.

well you dont know what a MCE extender is then. Stream live tv from a MCE PC, playback recorded DVR-ms files, etc.

i assume you are talking about MCE for the 360, cause MS also put one out for the original XboX. I dont record TV much so its not a concern of mine, but i can see it being an appealing feature, it will never happen though...
