I can get a replacement like the thermalright HR-03 that doesn't block another slot for $40 used or get something like the 8600 GS from Newegg for $70 AR (if it comes back in stock.) I have 2 weeks left on the warranty, so that's an option as well, except I'd be w/o my main computer for awhile.

I don't currently run Vista, but should I take this as an opportunity to get DX10 & also to get pci-e 2.0?

$70 for a freaking 8600GS? I'd rather pick up a 9600GT/8800GT for about $100 after rebate/discount.

I would replace the fan via warranty and keep on trucking. I have an X1950 Pro with an AMD FX60 on my backup rig and it will play just about anything. Pretty soon 8800 GTs and HD 3870s will be $100 so that might be a nice upgrade in a month or so.

I assume you meant an 8800GS for $70 AR right?

In that case, yeah, go for it. And sell the x1950pro on eBay as "new in box" once you get the replacement, because the 8800GS is a considerable upgrade from your current card. Or, better yet, because you can sell the x1950pro as new once you get it back, go ahead and upgrade to something even better, like the 3870 or 8800GT.
