To this extent, I agree that "zero tolerance" is bullshit. If the 12 year old was strong enough to fight them off (and chances are he wasn't considering that it's one 12 year old vs two 14 year olds) the parents could have complained and it would have been suspensions for everyone. But, of course, you show your sexual depravity by thinking he just "took it", like some pathetic rape victim.

8th amendment only applies if the boy's defence can convince some judges that this incident is in no way similar to known cases of abuse.
Much of it has to do with why they are doing what they do. In prison, weird shit like slapping someone with your dick while people are watching or sitting on someone's face are 100% about showing dominance and control. Doing that for the sake of intimidation or because it turns you on somehow (wtf) is the spirit of the law. If that's the situation, the sex offender label is completely justified because the kids really are sexual predators.

The only way out is if it's regular douchebaggery between friends. Example: Frank falls asleep drunk and his white friends put a carrot in his ass. Not for dominance, but because all white people are borderline gay and jump at the chance to do creepy sexual shit to their same sex friends. I doubt that is the case.
