WTF?? UPdated

I recently sold my Treo 90 on ebay, and in the title i used the "new". and then went on to explain that the treo had been used for a month (Very lightly i added, as it was) and that i was selling it. I included the leather case that it had always been used in in the auction also. So today i get an email from the girlfriend of the guy who bought it telling me that she wants to return it because it's missing the plastic case that normally goes on it and she's unsatisfied!!!! I dont know waht to say, i took off the plastic cover because it doesn't fit when in the leather case (told her that), and never thought twice about it, what the hell is going on here???

any ideas??

Well... if you never specifically mentioned that the plastic case wasn't included, I'd say they were justified.

If your ad never stated a plastic case was included, or stated "complete retail packaging" or something amongst that line, then you are in the clear.

i'm even trying to be nice and looking for a place that'll sell her just the cover, any ideas besides handspring.com?

they stilll haven't left me feedback (this was over a month ago now) and i dont want them to leave me negative for something so trivial as a plastic cover

Even if they do, it will sound so ridiculous that it wont affect your rating really. I've read a lot of bizarre feedback comments before and it just seems to be getting worse every year since ebay treats the whole feedback scheme as a game.

Who says she has to word it like that? If it were me, I would slam you over the fact that you claimed it was new, yet parts were missing, and you would not return my money.
Buyer beware, this guy sucks. Something along those lines.:)

Offer to send her the case if you still have it, or give her some cash back. If she still wants her money, then you should give it to her.

I think you are confused as to what the "cover" is. It's not part of the packaging, it's part of the unit.

At any rate, I think it's on you to make this trade right. Find a cover, compensate her, refund her money.... Whatever.

I don't see how you can put "new" in the title when the item is used, even though you explained it in the description.... very misleading.
I think "mint" would be a better description.

When I see new on the title, I expect NIB (new in box), with all the fancy plastic shrinkwrap packaging and the new product smell :p

I would just be glad Ebay didn't boot me off if I ran an auction like that.
First, you put "new" in the title when the item isn't new. That's not acceptable.
Then, you took part of the item OFF and didn't bother to mention that.
Send the money back, get your item back. Relist it appropriately.

contact handspring and see if they will send u a replacement, they sent me a battery door for a visor delux for free without a problem.

I'd be pissed too.... that plastic cover really helps to protect against accidental keys getting punched. Anyway, I would say it's your responsiblity to buy a cover for it if you didn't say it didn't include it and you advertised as "New" with some use.

I agree with the folks that say/think the cover is vital to the Treo 90. It's not just a clear plastic sheet covering the display just for you take off when removing from the brand new box... it's part of the Treo! It adds to the aesthetics and protects the keypad. I'd be pissed if I bought a Treo 90 that didn't look like a Treo 90. I know you're trying to correct the situation, but if you cannot find a replacement cover (that you'll pay for), simply take it back from them. They're obviously not satisfied with their purchase and you don't want a negative feedback.

I agree with the others, new is brand new, not pretty new. Really shouldn't have put that in the title even if you explained it in the auction details. With that in mind I'd find her a plasic cover and just give it to her.

I'll drill it in the ground too, "Like New" or "Almost New" would have been better.

If you only had the Treo for a month don't you still have the cover? Regardless if you use it or not, why wouldn't you save something so trivial? It's small enough to stick in a draw and forget about it.

Yes ebay can suck when people LIE in the title and dont send all the parts to the "NEW" prduct and then refuse to refund the money.


I suggest since you are the one that broke the deal that you send her the money back and do it fast before she starts to complain to ebay. If you get a nasty feedback then tough luck you deserve it.

Maybe then next time you list something you wont lie to try to sale it.

Is this your auction?

I'd be pissed too if you title the auction with "Brand New", then don't mention that it's used in the item description, and flat out list the specs from the Handspring website which include Removable flip lid and don't include it. I'd be unsatisfied and feel mispresentation is sound terms for a return and refund, but then again it probably wouldn't have taken me more than a few days to figure that out.

yea that auction is very misleading. it doesnt say anything about it being used in the auction. bidders shouldnt have to email you to verify thats it used if it says brand new in the title. theres even a pic of the treo w/the lid...ur lucky if they dont demand a refund and leave u a neutral/negative anyway. i know ppl who use ebay who have gotten negative/neutral for far less...
