What do you see as the problem? It seems about right based on your hardware and the D3 benchmarks I've seen the past few days.

Have AA on in the control panel? VSYNC on?

vsync is on. AA is off. Its seems low though doesnt it like i should get 40fps

Turn VSYNC off, run it, and then report back.

well i played the game with vsync off and there lines and things and the screen breaks and stuff when i look around. You kow what i mean

I had vsynch on, and got about 5 fps lower than when I turned it off and ran the timedemo...

with vsync on, the benchmark will lock to 30 or 60fps. so turn it off and your score will increase.
