WTF fined for filing state taxes late.

I know someone who paid their taxes well on time, but got an extension to file the state tax form. Apparently they filed a week past the exention date and was fined 1000 dollars by the state of california. WTF how can their be a fine when they paid on time. The fine was for filing late.

You're better off filing early and paying late than paying early and filing late.

I am thinking about telling them to talk to a lawyer. A 1000 penalty for not filling out a sheet of paper seems to violate their civil rights.

Who gives them the right to fine you for not filling out a sheet of paper.

The state constitution and tax laws give them the right...

Always file on time even if you can't pay on time. The penalties for failure to file are much greater than for failure to pay.

civil rights thing might be a bit much. But was just shock when they told me today about the penalty. I will say this, they will never file late again.

How could they pay "well on time" ... if they filed a "week past their extension" ?

On time = when its due.

I think you are confused. They paid the taxes from their witholdings on time. They got a 1 year extension to file the state tax form and filed it late. They filed a week after the extension ended. They were originally owed a 800 refund, but with the fine they owe an additional 200.

Part of your story doesn't make sense. Taxes are withheld from your pay...you don't "pay them on time." You file for a 6 month extension...not 1 year.

I've seen folks get penalized for failing to file, but never "fined" for failure to file.

From the FTB:

Failure to File a Return/Late Filing Penalty
5% of the tax due, after allowing for timely payments, for every month that the return is late, up to a maximum of 25%.
For individuals and fiduciaries, minimum penalty is the lesser of $100 or 100% of tax required to be shown on the return.
For fraud, substitute 15% and 75% for 5% and 25%, respectively.

mmm they didn't file 08 taxes until april of this year. That might explain why they got such a high penalty of 25%. They were many months past the extension date. They seem to have thi
thought the extsion was until the next year.

All right just stop right there.
This is a "he said, she said" situation because you are talking about a friend and a government. And you really dont know exactly what happened between the two. I can almost guarantee your friend held back some vital info to make themselves sound like the victim here. And since you will never know for sure you should probably just forget about it.
