if you don't come off well, they might lower it to something else, rather than throwing it out. they probably thought you were trying to run, so they decided to stick it to you.

Depends on what he told the officers when he talked to them. He likely made the statement that he was travelling over the speed beforehand, and at that point, it really doesn't matter if he went faster to avoid an accident, he already admitted to breaking the law.

He should obtain a copy of the police report/officer's notes immediately to check on what the officers recorded and submitted. If it doesn't say anything about what speed he says he was going, then he's got a better chance.
