I'm flabbergasted yet somehow not surprised that the bat manufacturer AND sporting good store was sued.

A New Jersey teenager left brain-damaged after being struck by a line drive while he was playing in a youth baseball game will receive $14.5 million to settle his lawsuit against the bat manufacturer, Little League Baseball and a sporting goods chain.

The settlement of Steven Domalewski's lawsuit was announced in state Superior Court on Wednesday morning in Passaic County. The boy, now 18, lives in Wayne, N.J.

"The Domalewskis are still saddened by the tragic events of June 2006, but this settlement provides them with some relief and comfort that Steven will get the care he needs for the rest of his life," said the family's attorney, Ernest Fronzuto. "He still can't perform any functions of daily life on his own."

Fronzuto said the settlement precluded him from discussing its details, including whether any of the defendants admitted liability.

Domalewski was pitching when the batter rocketed a line drive off the metal bat he was swinging.

The ball slammed into Steven's chest, just above his heart, knocking him backward. He clutched his chest, then made a motion to reach for the ball on the ground to pick it up and throw to first base to get the runner out.

But he never made it that far. The ball had struck his chest at the precise millisecond between heartbeats, sending him into cardiac arrest, according to his doctors. He crumpled to the ground and stopped breathing.

His father, Joseph, a teacher who had been on the sideline with the rest of the team, said he and a third base coach from the other team both ran onto the field, where Steven was already turning blue.

Someone yelled, "Call 911!" Within 90 seconds, a man trained in cardiopulmonary resuscitation who had been playing catch with his 9-year-old daughter jumped over the fence and started to work on Steven.

Paramedics, who were a quarter-mile away doing a CPR demonstration, got to Steven within minutes, placed an oxygen mask over his face and rushed him to a hospital. But the damage had been done; his brain had been without oxygen for 15 to 20 minutes.

"Pretty much, he died," Joseph Domalewski said in a 2008 interview with The Associated Press. "It was just so fast. The thud, you could hear. When it hit him, that seemed to echo."

Domalewski was playing in a Police Athletic League game, but Little League was sued because the group certifies that specific metal bats are approved for - and safe for - use in games involving children.

Rick Redman, a spokesman for Hillerich and Bradsby, manufacturers of the Louisville Slugger brand bat, confirmed a settlement had been reached, but declined further comment.

An attorney representing The Sports Authority, the national sporting goods retailer, did not immediately return calls seeking comment, and an attorney who represented Little League Baseball in the case declined to comment.

Little league Baseball also did not immediately reply to messages left at its corporate headquarters.

Little League reached an agreement with the major manufacturers in the early 1990s to limit metal bats' performance to that of the best wooden bats. Little League said in 2008 that injuries to its pitchers fell from 145 a year before the accord was reached to the current level of about 20 to 30 annually.

Little League also said on its website that it has banned most metal bats for younger children for the 2012 season, although certain ones found to meet the organization's testing standards are allowed to be used. League divisions for older players can use metal bats subject to certain weight and size limits.

This is just stupid.

When you play baseball (or any sport) there is certain level of danger involved. Freak accidents will happen.

WHat's next? Foam bats only?

Our justice system is screwed up.

Wow... I feel horrible for the family's loss, but really 14.5mill?

No I take that back, I don't feel sorry for them. Why not sue the baseball manufacturer as well?

Someone at my office was talking about this very thing.. Apparently his son plays in some little league where each bat has to be certified to not exceed a certain power, and these bats were very well-known to be "hot".. Somehow the manufacturer paid off the certification people, or something along those lines. From what he claims, they dramatically overpriced the bat because of this... Enough to where other teams would only use this one bat and trade it off between players.

He's one of the bs'ers, so I didn't really put much validity into it... Just throwing that out there. IF this company did pay off the certification people then they deserve to be sued.

You want to get really angry, check out the settlements paid (and by which parties) to the victims of the Big Dig panel collapse, and especially the club fire in R.I. that killed 100 people during a Great White concert. Best that you not be eating or drinking anything while reading up on those settlements, you might aspirate or spew something.

just banned all metal bats from little league, and made all the kids use wooden bats ONLY. Or make the baseball softer. lol

During our mens softball league this summer, I took a softball off the face due to a bad bounce. I think I might sue the people who make the balls and also the city for having a lumpy field.

Sport and physical competition can never be without risk. Someone can die from a "perfect" line drive off a wooden bat. What are we to do, ban contact- and ball-based sports? Shit, just exerting yourself to the max can kill you if you have a heart defect that is difficult to find in screening tests; play hard for three years, all of a sudden one day, at practice or a game, you just drop and die. We need to prevent this! Ban exercise altogether! It's too risky.

Apparently I didn't hire the right lawyers when I got hit by a car when I was a youth. I could've sued the car manufacturer, the car brake manufacturer, the car brake pad manufacturer, the car brake fluid manufacturer, the car brake fluid line manufacturer, the road the car was driving on, the city for improper maintenance of the road the car was driving on, the national weather forecast department for the rain that happen, my landlord, my neighbors, the pedestrians who were on the sidewalk that night, the umbrella manufacturer, etc. My stupid lawyer settled with the car insurance company for $15K. Motherfuckers.

I recall reading something like that actually. There are a few bats that really should be banned yet they are allowed. They are a few hundred dollars more then others because of it.

it's rather insane how powerful some of these bats are now.

Possibly for advertising in print that the bat was "certified" (grasping at straws here)

I don't think the article states if it's an equal payout, just the entire sum.

My sympathies to the kid, Sports Authority, the bat manufacturer and Little League Baseball, fuck everyone else involved in this extortion. Family should only be getting hospital fees and maybe a million more for taking care of the kid in a just world, instead they'll probably live high on the hog while in the end they do still have their son. Sorry if that's cold but it's shit like this opens up the door even more for people to make money off genuine ACCIDENTS. I mean you signed a fucking wavier, shit happens, in the end it's still a sport and kids will get hurt.

Seriously, when metal bats were first introduced they were a menace. Balls are hit so much faster its beyond human reaction time. Almost no one realized this and there were a lot of injuries.
As a former pitcher I can attest to the fact that the ball just comes at you so fast off a metal bat you can't react. I was just getting out of baseball when they were coming in, and after like 10 years of pitching I altered my finish to put my glove in front of my face. It was scary.

So, yes, if a company comes out with a new type of way of making a product that makes that product dangerous it is up to the companis, which knew full well it was dangerous, to label their product as such.

And that is the real story behind this thread. The manufacturers didn't want to lable the bats as potentially dangerous which would have badly hurt sales.

At this point it is well known how dangerous the metal bats are and there are now leagues that only permit certain types and brands.

Fucking this. I got hit IN THE EYE after failing to catch a pop fly when I was a kid. It messed me up pretty bad but we didn't sue.

During the same summer, a friend got hit in the head with a line drive and had issues for a while as well.

This is a BS lawsuit.
