To identify problem workers under the influence on the job. Even scarier is the threshold is BAC 0.025! Better not gargle listerine or take nyquil before reporting for duty!
 
No, but I do support employers being able to fire you for any reason, so if they suspect you of drinking they can just fire you...a breathalizer is an invasion of privacy though, IMO.

No. Maybe at the legal BAC. How many times have we all gone to work still loaded from the previous night?? I can count more than a few times for moi.

Some places have random drug testing and can require a drug testing on the spot. At least that is how itis in Virginia to my knowledge.

I'd be wary of such a law. seems like a bit of an invasion of privacy. maybe for certain jobs, like ambulance driver, police officer, operators of heavy machinery
 
Invasion of privacy? I think employers have a right to not have drunken employees, though at that BAC level there is a lot of room for error and misinterpretation. It might put a damper on the two martini executive lunch too 🙂.
 
Is it really so hard not to drink while at work? I wouldn't mind if they went with a more realistic number (like the legal limit).
 
I would have no problem with it, I don't think an employer demanding that you be sober while at work is unreasonable. Drug testing is already the norm when you have an accident.

If you feel that it's an invasion of privacy you can simply refuse the test and find a new job.

At my work they can test (urinalysis) anyone they feel is showing signs of intoxication.

They also test anyone that sustains an OSHA reportable injury.

the number does sound low

but that wont matter to a customer when they encounter an employee with alcohol on their breath. theyre not about to care if theyre sober enough to do the job, but that you can smell it.

weve had a few employees come into work after drinking too late. they were easily sober enough to work, but they reaked of alcohol and other employees, nevermind customers, dont want to be around that all day.
