I bought Myst 4 and 5 from a guy that advertised the games as new in retail boxes (showing the North American images) and when I got the games, one of them was a sealed DVD case of a European copy of the game. The other game was a retail North American copy.

Would that make you upset?
 
Has happened to me once on a $10 purchase. Not worth the effort to even bother. Yes I was upset, but not much you can do.

The copy of the game that I bought said not for distribution in the United States or something to that effect. Essentially it was illegally sold to me. Perhaps the same issue that the OP faced?

Can games be region coded? If so, the game may not work.

I could also be upset if I was wanting the box as part of the 5 game collection.
