Would anybody like to help me with my Street Law Exam?...Please?

OK, first off, i have no clue why I ever chose street law for my elective, but my last exam was decent. This one isn't even worth as much of my grade as the last one, but it's 10 times harder. Here are the questions, and if anybody could do any of the for me, that would be great. (I still have a whole other section which I am currently doing on my own.) Also, if anyone is wondering, it's a take home exam.

Part 1: Create an original negligence case. Identify all the elements of negligence in your case. Explain why those elements are valid, and then devise a plan of attack if you had to defend the negligent party.

Part 2: Create an original Strict Liability case. Explain how the facts rise to the level of strict liability, and then try to present a defence.

Part 3: Create a situation in which a valid contract exists. Describe all the elements of a contract in your case and then, choosing either or both parties, decide how you would argue to break the contract.

Part 4: The Amendments

1. Look at the first and second amendments. Describe any controversies surrounding these amendments that you are aware of, and then, tell me whhere you stand on those arguments and why,

2. In a short Essay describe the impact of the Fourteenth amendment has had on state authority (sovereignty). Is it the wording of the amendment itself or the later Supreme Court interpretations, or both, that have brought about this impact on state authority? Finally, do you think the fourteenth amendment in any way conflicts with the ninth and tenth amendments?

P.S. On Exam Sheet: I give extra credit for creativity, effort, humor, and je n' sais qua.


Any help would be greatly appreciated. Also, i stand firm, i will never take any course concerning law again.

Well, at least you're open about wanting to cheat. Since this is a law class you should be offering to bribe people though.

lol, like u've ALWAYS done everything the right way? never cheated ever?

plus...take home exam = u can cheat a little bit, thats y its take-home, ;)

Hmmm.... as one of AT's resident lawyers (there are more here than y'all may realize), I am wondering if it would be ethical for me to sell my services to this kid. A consultation of sorts, if you will ;)

It seems to me this is as much a test of your imagination as of your technical knowledge. Obviously there are unlimited numbers of possible scenarios for the first three questions. IMO strict liability is the most fun of the questions, followed by the negligence question.

Generally, a person who owns an animal known to be vicious (either a dog that has previously bitten someone, or an exotic/wild animal like a tiger or venomous snake) is subject to strict liability for injuries caused by the animal - to me that is the most interesting factual scenario to use for that question.

One interesting scenario for the contracts question might involve the sale of a piece of property (say, a car), in which the selling party took affirmative actions to disguise a known defect, rendering the contract invalid. We read a great case in my Contracts class in which a guy bought a house from another person, who told him, among other things, that there had never been any termite problem in the house. The buyer noticed that the seller had left a piece of furniture (some kind of cabinet, as I recall) behind, and when he moved it, he found termite damage on the floor underneath the cabinet. Even better, there was a pamphlet in one of the cabinet's drawers called "Termites: the Silent Scourge."

There is no lack of online resources on the First and Second amendments. Some of the most contentious issues in 1st Amendment law in recent years have involved flag burning and "virtual" child pornography.

The state sovereignty question is probably the most interesting and challenging. Again, you will find no shortage of material on this online.
