So they have this 25% off sale on PNY graphics this week. No store in the whole US has a 6600GT in stock when sale starts last Sunday. Today, I checked and website said my local store had them!!! So I go trucking up there only to learn that no, they do not, but some are coming in - just in time for sale to end.

You are legally entitled to a raincheck for any item in the week's flyer, unless it has a "quantities limited" disclaimer.

I didn't call because most BB employees are morons - just as was the guy I dealt with live. Couldn't even manage a simple search on own website to locate. I finally had to do it for him. I also understand BB still has a serious employee five finger discount problem. Outright theft or "open box" scams. Pretty sad all around.

I can't stand Best Buy anymore, I've vowed to stop buying stuff from there.

What do you mean by "legally"? Is there an actual law that states that?

Is that until the next time they have some good deal there?

yes.

it is illegal to have a sale and not to have the item on sale in stock. If they offer you something else instead and its more expensive, then they are guilty of bait and switch. Also very illegal.

I only shop at bestbuy for their loss leaders I can't see helping them profit when they are run so poorly and show little regard for customers.

What if their stock runs out. as is the case?

depends on how many they had and when it ran out.

I have seen this happen before (FutureShop). I bitched very strenously about it. I went through the usual song and dance with them. "We had some in stock but we sold out in one day." Oh, Really? It was a CD burner that was normally $300 that was for $200. I am really sure they sold 10 of them in one day. They had cheaper units in stock. I asked for a rain check and the guy said no. I asked why, and he said "rainchecks don't apply to computer electronics." So I said "I see, so that scanner I got on a rain check the year before doesn't apply either." I went and talked to a manager about it and was told a raincheck was no problem. I asked when will the drives be in?" He said he's not sure and it could be a week or a month. I said I will think about it.

I got an identical drive from a local store for less than the FS sale price.

I'm pretty sure there is a law that they do have to give you a rain check unless the ad says "Quantities limited to stock" or something along those lines. If nothing else, place a quick call to your local Attorney General Consumer Protection office and ask them the specifics.

Ad doesn't say "Quantities limited" or "QL to stock", but does say "Rainchecks on insert items only" - not sure exactly what that means. Furthermore, there never was stock, apparently at ANY store, so there may be some legal ramifications here. However, the ad didn't specify 6600GT, just all PNY graphics cards, so I'm sure they'd weasel out of it. They suck. Always have, always will. Only considered buying there because of sale and $50 gift card I was given at Christmas, otherwise I stay far away. Picked up the Antec case on sale instead, so wasn't total bust, just not what I really wanted.
