21 year old Australian woman hits a cyclist from behind and fractures his spine, after texting 44 times during her short drive. After hitting the guy, she parks 300 yds away and makes no move to help him.

Her reaction to the police?

“I just don’t care because I’ve already been through a lot of bullshit and my car is like pretty expensive and now I have to fix it,” she told a police officer.

“I’m kind of pissed off that the cyclist has hit the side of my car. I don’t agree that people texting and driving could hit a cyclist. I wasn’t on my phone when I hit the cyclist.”

The cyclist was on the edge of the road heading west when Davis hit him from behind, despite there being lights on the back and front of his bike.

Records showed Davis used her phone 44 times in her drive from east Warrnambool to Koroit, sending and receiving 22 text messages to seven different phones.

At 7.18pm she received a text message and 51 seconds later made the call to triple-0 after hitting the rider.

For all this, she spent zero time in jail, was fined but $4,500, and lost her license for a big 9 months.

Oh, and her name is Kimberly and she lives in Port Fairy. All in all, I don't think I like her all that much. :colbert:

Well... can't fault her for her honesty at least.

But yes, it's pretty disgusting.

That is hard to believe ... and horrible. A close second is the DuPont heir who got no jail time for the rape of a 3 year old (probation and a whopping ~$4000 fine) because the judge said "he would not fair well in prison"

The war against cyclists has finally begun!!!!!

You bikers brought this on yourselves with your "we own the road" attitudes.

Huge sales boost to the "share the road". "watch out for cyclists", etc. bumper stickers.

They prey on situations like these. Those people are the real scum.

I have a 21 year-old daughter, and I don't think you guys fully comprehend the extent to which young adults of that age live in their own little worlds. In three years that person may be an adult you'd be happy to spend time with. Or not. The jury's out until you're like, 23 or 24 I think. At that point, if you're still an asshole chances are good you're just an asshole.

Second thought: this is why I refuse to ride my bike in the same direction as auto traffic. I still don't get why people think that's a good idea. I want to see the cars coming, period. My bike is not a car. It has a minimum 15 mph speed differential between it and every powered vehicle on the road. It has no protections at all for me in a collision. And I'm supposed to trust that the steady stream of distracted, texting, talking, mp3 selecting, window gazing drivers is not going to include a single person who is capable of drifting three feet to the right while doing any of those things? Screw that.

Is this an entitlement thing, or just that she's an asshole?

25. That's when insurance companies consider people a...dolts. Before that they are considered mega dolts.

To be fair she had been through a lot of bullshit and her car is like pretty expensive and now she has to fix it.

The faster we get self driving cars the better.

People who ride bikes against oncoming traffic are idiots. When you ride a bike, you are operating a vehicle and should follow the rules of the road. Would you ride your motorcycle or scooter into oncoming traffic?

I am not anti-biker as I ride my bike on the weekends and it irks me when I see one of these idiot bikers coming towards me. I am following the rules of the road, they are not so they better get the f*ck out of my way.

I don't know Aussie law, but in the USA she would be looking at a very large civil suit, such that she might never need to worry about owning an expensive car again. Actual damages would be huge, but punitive damages could be much greater, as in large enough to fit the persons wealth and be painful.
