Okay, my job here at work is office work and drafting (electrical and mechanical).
But, I am good with photoshop and have my own copy, and I generally enjoy doing it, so I do favors for people at work for free.
I make posters, pamphlets, banners, and modify images. It's simple and easy and fun for me.

About a year back work asked me to make something for them in photoshop for the retirees. Something with a picture of the plant, the name of the plant, and tie it in with Texas. I was asked to put a Texas flag in the sky if possible. I didn't do that exactly. I covered the entire sky and just made the opacity around 25% for the flag.
So I put this all together, gave it a few kicks of my own. It looked nice and everyone enjoyed it and they give it out in a frame to everyone who retires.

Fast forward to yesterday. I was told that previous to me, the company approached someone else about doing something like this. He was going to be hired to take some photos and get with the company about ideas for this retiree business. Well they looked at his portfolio and didn't like his pictures. They dropped that idea. That is when they approached me.

Turns out he came up with the idea for putting the flag in the sky over the picture of the plant. He didn't do it, but in their meetings he thought that part up. He saw what I did, and now he is angry that his idea was used but he was not paid. But they were never going to pay him for his ideas. Just for use of his photos.
Now, I wasn't paid either. Nor was I given any credit at all. No money is being made off the idea. In fact, they spend $30 per retiree to have it framed and what not.

What kind of claim does he have on this "idea". What kind of damage can he do. He does not know what he wants yet, but I have a feeling he contacted a lawyer.

shouldn't the company lawyer be dealing with it instead of you worrying about it?

you did this at the direction of your boss? then it was done on company time and the company should be liable, not you personally

sorry but putting a flag in the sky is not uniqu or new. I don't see how how he could have a lciam for that.


but i am sure he can dosomething heh

For his claim to succeed he needs to prove that he had proposed that idea, if this claim is acceptable then you need to prove you had no prior knowledge of his design ideas.

Tell him to go screw. Tell him you didn't do it for profit, received no money, and was simply an original work that was given as a personal gift from one person to another and tell him that if he can't prove otherwise, enjoy wasting money with a lawyer. :)

Well, you did it at the behest of the company -- so you aren't liable, the company is. Don't worry about it unless you get a lawsuit directed at you (which should be easy to defend given the truth). Tell the truth when asked (but don't give out information unnecessarily), ask your management and talk to your corporate legal team.

Even if they paid you the guy wouldn't have a valid claim. You can't copyright an idea.

Well they have the original emails where the idea was talked about.
And no, the idea is not new. No one is blaming me, he just wants to take all the credit for the work I have done. He keeps mentioning a copyright, but I am not sure what he is wanting to copyright.
Personally I believe he is being selfish.

He has about as much as a claim as Enimem telling other rappers that he has "copyrighted" rap and no one else is allowed to rap.

He can't copyright and idea, and since you did all of the work, he can't copyright what you did.
Refer him to your corporate counsel and don't talk to him when he calls/emails.

Can you show us the final product?

I can't stand it when the flag is changed around or the star is replaced. The "Texas A&M" Texas flag is very dumb looking...they remove the Lone Star, add a blue map of Texas and Texas A&M text. I'm hoping Texas A&M doesn't support this because it makes me mad to attend the school.

Hopefully, you just made it opaque. :)

I don't even have it in digital format anymore. It wasn't some huge ordeal. They needed something fast, told me about what they wanted, and I did it in a few hours.
I have long since deleted the file as I had already put it on a disk and gave it to them.
