Okay, my job here at work is office work and drafting (electrical and mechanical).
But, I am good with photoshop and have my own copy, and I generally enjoy doing it, so I do favors for people at work for free.
I make posters, pamphlets, banners, and modify images. It's simple and easy and fun for me.
About a year back work asked me to make something for them in photoshop for the retirees. Something with a picture of the plant, the name of the plant, and tie it in with Texas. I was asked to put a Texas flag in the sky if possible. I didn't do that exactly. I covered the entire sky and just made the opacity around 25% for the flag.
So I put this all together, gave it a few kicks of my own. It looked nice and everyone enjoyed it and they give it out in a frame to everyone who retires.
Fast forward to yesterday. I was told that previous to me, the company approached someone else about doing something like this. He was going to be hired to take some photos and get with the company about ideas for this retiree business. Well they looked at his portfolio and didn't like his pictures. They dropped that idea. That is when they approached me.
Turns out he came up with the idea for putting the flag in the sky over the picture of the plant. He didn't do it, but in their meetings he thought that part up. He saw what I did, and now he is angry that his idea was used but he was not paid. But they were never going to pay him for his ideas. Just for use of his photos.
Now, I wasn't paid either. Nor was I given any credit at all. No money is being made off the idea. In fact, they spend $30 per retiree to have it framed and what not.
What kind of claim does he have on this "idea". What kind of damage can he do. He does not know what he wants yet, but I have a feeling he contacted a lawyer.
