Yep; in most states, as far as I know, DUI is a misdemeanor. Think it only gets bumped up to felony if someone's hurt, or possibly if there's significant property damage. I could be wrong, though.

Most states have language similar to what pontifex posted for PA which a DUI can certainly apply. Driving drunk certainly would be considered acting in a manner dangerous to public safety.
