the employees that got laid off and the ones that had their hours cut should be lined up and allowed to punch her in the face and give her a few swift kiks in the ass..


if i was the ceo of wendys and anyone tried to pull this sh1t....id have all my resources and legal dept coming down on them until they were out on the street begging for pocket change...

Unfortunately she's probably judgment-proof, but Wendy's and the laid-off employees will have a good cause of action against her if it's proven she made this up. I imagine the corporation will sue her anyway, just to make her life unpleasant (which she richly deserves IMO).

All employees denied knowledge or involvement, police said. The California Department of Health Services traced the food products back, and found no contamination or accidents that could account for the severed finger.

And finally, testing conducted by the Santa Clara County Medical Examiner's Office showed the finger had not been cooked at 170 degrees for three hours, as Wendy's chili recipe is. The tests also ``disproved some of the statements made by suspect Anna Ayala in regards the finger in her chili.''

Where the finger came from, however, was not disclosed, if investigators know.

Ayala is scheduled to appear in a Clark County courtroom on Tuesday, according to the Clark County District Attorney's Office. At that time she's expected to indicate if she will fight extradition to California. She is being held without bail until the hearing.

Police also said they have found 13 civil suits involving Ayala and her children.

Thursday night, police arrested Ayala in connection with the case at her Las Vegas home.

She was charged with attempted grand theft in connection with the chili incident, and one count of grand theft in connection with the real-estate deal.

The criminal complaint filed in Santa Clara County Court Thursday put the value of the attempted theft against Wendy's at $2.5 million. It wasn't clear how that figure was arrived at. The company says it has lost $1 million a day since the incident.

The grand theft charge has nothing to do with the Wendy's incident. It involves her alleged swindling of a woman named Bertha Davila, a San Jose woman from whom Ayala accepted $11,000 as partial payment for a mobile home that Ayala didn't really own. Police said she took the money and moved to Las Vegas and let the proposed deal fall apart.

Wendy's has lost millions. Dave Thomas is turning in his grave. I think everyone needs to eat more at Wendy's than they usually do until they make the $ back. Yeah that's it...good reason for me to eat more fast food.

Usually police statements are more informative regarding what facts they have to back up assertions she's guilty.

It may not have been cooked for 3 hours, but it could have been planted by an employee as a joke.

I'm no more certain she is guilty than believing the arrest was made at this time simply to appease the Wendy's chain.

Wendy's also has hired private investigators, set up a hot line for tips and offered a $100,000 reward for anyone who provides information leading to the finger's original owner.

Now I'm more certain they can't prove it because obviously they have no evidence of her planting it or scheming to plant it. Until they find where it came from, I doubt they will get a conviction (unless she confesses).

From the article:
"But according to a person knowledgeable about the case who spoke on condition of anonymity, the attempted larceny charge stemmed from San Jose police interviews with people who said Ayala described putting a finger in the chili. The source said the interviews were with at least two people who did not know each other and independently told similar stories."

As to the employees putting it in as a joke, they passed lie detector tests.
