It is clear from the article that the kid was chasing after her hard and she caved in. If you are a guy and you are pursuing a female for sex and she relents and has sex with you, did you get raped simply because you are 13?

Short answer to that is no. The Catholic church engaged in a systematic cover-up. Not anywhere near the same as anything involving teachers.

If the numbers are to be believed, the percentage of people who sexually abuse children in the Catholic church is not really any different than the general population. The main difference was the cover-up, so serial abusers amassed a great many more victims before being caught compared to the general population.

I get that but I also understand what it means to be a 13 year old male. When I was that age I thought of sex nonstop. I would have given the world for ANY female to have sex with me. It would have been the greatest event of my life up to that point. The thought that a female should be charged with a crime for fulfilling my fantasies just seems odd.

I had to wait until I was 19 before I got laid and remember the admiration, resentment and jealousy that I had for all the other guys who were getting laid in high school. I still live with the regret that I didn't get laid in high school. Sex gets DRAMATICALLY worse as you get old. You exist on earth for a short time, you should pack as much pleasure into your youth as you can so that you have something to look back on. If you don't get laid when you are young, you will always regret it..... if you do get laid you will always fondly remember it. If you are young, always be cognizant that the pleasurable part of your life is basically over by the age of 30, that is when you begin waiting to die.

I think you're confusing what the crime is here. Sexual maturity level is one thing, but deciding whether or not to have sex with a child, or in this circumstance, not to wear a rubber when being inseminated by a child, are not choices a child should even be presented with. Sure, the 13 year old (as well as his entire family in this bizarre case) may have wanted it, but the 25 year old broke the law. The teacher is in a position of protecting a child. This isn't a matter of the 13 year old getting his kicks in. It's a matter of a teacher having sex with a child. Or fulfilling the sexual fantasies of a child, as you put it (which is remarkably disgusting, btw).

I was providing a definition. I don't inherently disagree with you.

No one in my mind is "competent" until they are 25, and really that's not "competent" so much as "as competent as you're likely to get". We are simply damned by the biological fact that our physical development and capacity for and drive for sexual relationships precedes maturity of our decision making. And of course we can't assume a standard developmental timeline either physically or mentally.

As such, these statutes are as much driven by societal dogma as any biological standards.

But anarchy is not correct simply because laws are destined to be flawed.

In this instance, the 25-year-old has capacity to understand and execute autonomous sexual decisions per the law, and the 13-year-old does not. Thus, by statute, non-forcible sex between them is rape.

Stupid people are easily manipulated, including some of the elderly. IQ differences can be vast. Should we make it illegal for people to have sex with the elderly or stupid people?

Putting people into prison and juvenile jail unnecessarily can't be defended by refusing to see people as individuals to the necessary extent. I was certainly rational at 13. A lot of adults aren't rational at 40.

America is a culture of imprisonment and punishment for sex.
