At some point in her conversations with internal affairs investigators, Moore grew frustrated with their attempts to intimidate her. So she began to surreptitiously record the interactions on her Blackberry. In Illinois, it is illegal to record people without their consent, even (and as it turns out, especially) on-duty police officers.

it's legal to record the officer in every state but Massachusetts and Illinois. Arrests still happen in other states, but there's little legal justification for them, and the charges are usually dropped, or never filed at all.

Recording an on-duty police officer in Illinois is a Class 1 felony, the same class of crimes as rape.


She gets 4 to 15 years. :eek:
WTF?!

Illinois has absurd eavesdropping laws on the books. Seriously. Even if you aren't a cop and someone records you, the punishments are severe for that other party. They had to write an exception into the law to allow the police to record traffic stops...thats how locked down it is.

Cops can suck sometimes, in any country. But it is the law that truly sucks here.

a maryland judge recently ruled that officers have no expectation of privacy while performing their duties in public, and disallowing such sets dangerous precedent for the abuse of power by the police (go figure).

the maryland case was the one where the guy on his motorcycle was pulled over by a plainclothes cop and the cop whipped pulled out his gun without identifying himself as an officer.

Is this the same law that requires America's Funniest Videos, Amazing Cop Chases etc., shows to have consent from all persons who are in a submitted video?

I hate Illinois Nazis.

But yea, recording them in an office meeting is different than publicly recording officers in the street.

These laws are pretty stupid. It is up to the citizens to have them taken off the books. The citizenship can almost always overrule the legislature.

I've yet to find a honest one here in Chicago. WTF happened to "to protect and to serve"? Hope the new mayor can fix this (crosses fingers).

That turned into "Service with Pride" a few years ago. At least that's what it says on the cop cars up here.

There should be no expectation of privacy while in public by anyone, especially these days. Between security cameras and cell phones you should pretty much expect to be on some kind of recording anytime your out.
