Edmonton Woman Refuses To Pay $85 Fine, Does 20 Minutes In Jail

POSTED: 12:39 p.m. EST December 5, 2003
UPDATED: 12:48 p.m. EST December 5, 2003

EDMONTON, Alberta -- Olga Friesen's day in jail lasted just 20 minutes.

The Canadian woman says she'll do it again if she has to, rather than shoveling her sidewalk in accordance with city regulations.

The 69-year-old Edmonton resident arrived at the courthouse Thursday ready to go to jail after refusing to pay an $85 fine.

The incident stems from a ticket she received last February for not shoveling her sidewalk down to bare pavement.

She was escorted to a basement room, frisked, did some paperwork, and was then released.

Friesen said that if the city doesn't change its bylaw and other citizens don't stand up for their rights when they receive unfair tickets, then she's accomplished nothing.

City officials say they won't change the bylaw.

Heh...what if you physically cant do it?

She doesn't have to shovel it, she only needs to use some rock salt or Heat.
The lazy old lady just wanted to make a point.

On the other hand, if she was like 90 and crippled in a wheel chair, would she have to do it still?

Speak for yourself and your state. We have more sense than that in Ohio.

A Landowner May Not Be Responsible For Injuries Of A Guest Who Slips On An Icy Sidewalk
  • Living in Ohio during the winter has its inherent dangers . . . however, we find that Ohio law imposes no such obligation [to shovel and salt a sidewalk as a courtesy to social guests] . . . and we are unwilling to extend homeowner liability to cover slip and fall occurrences caused entirely by national accumulations of ice and snow. To hold otherwise, would subject Ohio homeowners to the perpetual threat of (seasonal) civil liability any time a visitor sets foot on the premises, whether the visitor is a friend, a door-to-door salesman, or politician or even the local welcome wagon.

The only point she's making is that she's stupid. If she can't shovel the thing she needs to snow blow it, put a ton of salt down on it, or pay somebody to do it. It's the law that homeowner's are responsible for their walkway. Having spent years in canada I can vouch for the agoniznig annoyance of the few people who never grasped this simple idea. Silly cow.

the part of that story thats missing is she did shovel it.. but not to the bare ground. She left a layer on because she said this way it wouldnt turn to ice. But actually... isnt that layer more slippery than the bare ground? normally thats the part that melts and refreezes.

She should have salted it then. I've never seen salt turn to ice :)

I had to get a homeowner's insurance policy that covered slip-and-fall on my property including the sidewalk.

Still, I shovel it. Doesn't really do any good for the pedestrian when your neighbor doesn't shovel their sidewalk though, does it ?

I misread the thread title... all I saw was "jail... women... 69."
Click in, skim posts, realize it's about an old lady and snow, get disappointed.
Bah humbug.

-30 celsius will simply freeze all the stuff the salt has melted, and make a tremendous icy mess.

wtf when are laws going to catch up to common sense and make people responsible for their own actions?

Newsflash: if you spill coffee on your self you fvcked up, you deal with it!

If you slip and fall, you fvcking walk like a retarded chimp on acid, you deal with it!

Avoid the damn ice spots or learn to walk on ice, stop suing people over your own stupidity and take some responsibility for your actions. It's not the homeowners fault you're too stupid to avoid or learn to walk on ice. I've done it countless times and I hardly ever fall. And if I do nothing breaks. But I'm young. If I were old with brittle bones i wouldn't fvcking walk on the damn ice I would avoid it.

but if I were to fall and break something on ice I wouldn't sue anyone over it.

What's next? Sue people cause they gave you the flu? And you lost a week of work?

How about sue your company because you got the flu there and they didn't provide a flu-free environment for you to work in? Oh you say you can't prove you got it there? Well how about sue the city because the flu virus is somewhere in the city you contracted it in?

While we're at it let's sue the professor everytime we fail an exam. After all it's their job to teach you right?

It couldn't possibly be your fault you fvcked up could it?

/end rant....we now return you to your regularly scheduled nef session.

Damn those are some good ideas, actually.

I think sueing for a slip and fall is retarded. Always have. But, people still should be held responsible for doing their sidewalk with a small fine if they don't. If they don't and you break your back though you're a dumbass and should have been more careful.

In my town downtown businesses don't even bother to shovel their walks. It's a real problem since a lot of elderly go downtown to get medicine from the drug store. They fall and break bones, yet people still don't shovel.
