Wobbling chairs

I found a chair I like at Fry's that's similar to this one. The first two times I went to check it out, it was solid with the tilt control set to "locked" (it only turned left and right but not forward and back). Then I went back last week and it would wobble back and forth a few inches even when locked. I had a cheaper $80 chair a few years ago that always wobbled like this so I never used it.

Is this just a result of poor workmanship? How can I tell if a chair will develop wobble? The guy at Fry's said this behavior was "by design" 🙁
