It is. The laws are in place for a reason, as they should be. If a 6-year-old "wanted" to give you a blow job and you let him/her, should that be illegal? At what point is a child old enough to make sound decisions? Obviously this varies by child, but when it comes down to it, the law has a duty to protect those who cannot protect themselves.
Here are the official "Reporting Guidelines for cases involving sexual activity between minors and between minors and adults" in the state of CA.
Regarding voluntary sexual activity and no other factors indicating child abuse (i.e. neglect, abandonment, pedophilia, predatory criminal intent, etc.), the following acts are illegal and a child abuse report is required by law:
1. If the child is under 14 years of age and the other party is 14+,
2. If the child is under 16 and the other party is 21+,
3. If the child is 14 or 15 and the other party is 10 years+ older than the child,
4. If the child is under 18 and the other party is any age if there is rape or incest.
Reporting is NOT legally mandated if the two parties involved are under the age of 14, if conduct is voluntary, and participants are "of similar age" (i.e. both 12 or 13).
Reporting is also not legally mandated if both parties are 16+ and the behavior is voluntary sexual intercourse.
This story made me very sick and sad. The 11-year-old girl obviously has other issues, maybe identity issues, attention-seeking tendancies due to abuse or neglect at home, a history of molestation or sexual abuse, etc., but regardless of all of that, she is an 11-year-old girl.
