Depends, some locations have open wireless for people to use freely.

Most of the time it is just someone who doesn't know how to secure their network. You are stealing from them.

You can usually tell if they intended to by the SSID.

I doubt you can be charged with anything if you just use the Internet connection. If yous tart trying to snoop their computers and such, then that's definitely illegal.
