Will we ever see abortion on the ballot?

It seems to me that if we can see states put gay marriage initiatives on their ballots, it could be in the scope of state governments to put bills re: abortion on the ballot.

Do you think this will ever happen?

You have it the wrong way around.

IIRC, Roe vs. Wade was argued up to the Supreme court as a clarification of existing state laws.
Once the decision in that case was made though, it became a Federal level decision, which trumped
(or equalized) that position in all the states.

States are able to pass current marriage initiatives because that decision has so far been "left up
to the states". If someone wants to challenge those laws on their Federal Constitutionality, then it might
go up thru the courts.

In the case of abortion (or an abortion ban if I read your post right) it would need to be made a ballot issue in a large enough majority of states to override the federal decision.

Will we ever see abortion as a ballot issue?

Perhaps, but first we'll have to get a court which doesn't pretend the Tenth Amendment doesn't exist.

BTW, for the pro-choice folks out there, it's okay to hold your POV on abortion yet still admit that Roe v. Wade was one of the worst Supreme Court decisions ever. Mainly owing to the premise on which the case was decided (an invented right found nowhere in the Constitution) and the sheer chutzpah of the justices in creating fiat law of this scope. Although I agree with the results of Roe I'd trade its reversal in a heartbeat for the chance to do it the right way, by legislative act sanctified by the will of the people.

I would like to see California vote to be come an independent country.

That'll get a pretty widespread level of support outside of California as well.

Hey, the Arnold could become "President" 😉

CsG

Yeah, wouldn't that be something. Even Arnold would be better than Bush. Think how tragic that is.

In other words...the people outside of California 😛

Seriously, the conversation would go pretty much like this.

Cali: "I'm leaving..."
Jesusland: "Sure, go ahead, we don't want you hippy communists anyways!"
Cali: "...and I'm taking my 15% of the US GDP with me. Also, you'll have to go back to getting your wine from France."
Jesusland: "Please stay!"

Uh, as for the topic, I expect it to show up sometime soon. It's already being grumbled about, and now that we've established the idea of using ballot issues to force what were previously considered personal choice issues on people who disagree with you (as long as they are a minority of course), I expect to see a lot of this.

Yay for ban on abortions and 16 year olds getting beaten with baseball bats to produce a miscarriage instead.

It is so much better doing it "the holy way".

For those of you who do not understand how that works, well i guess you are just bigots and child murderers.

pwaise the lewd.

I hope that abortion will never see the ballot while the nazi party is in power.....
yeppeeeeee...lets go back to coathangers.....outta sight outta mind for republicains though....you can always send your kids to california...or mexico...when reality hits your jaw.

I'd like to see it on the ballot. Every state vote. Enough of the legislating by judicial fiat.

Thank christ the constitution protects women from creeps like you.
