Why is the Radeon 9500 hack legal?

Why is the Radeon 9500 hack legal, yet it is not legal to hack an XBox? Does the DMCA only apply to certain items?

You paid for it, you can do whatever you please with it. It voids your warranty, thats the most they can do about it. It's ATI's fault they were to lazy to make the 9500 unhackable.

Ya, the DMCA should only apply to copyrighted digital material (of course the RIAA would make it apply to the air we breath if they had their way).

I'm not sure how you might even equate the two.
