Why is my new Ipod Mini shutting itself off all the time?

Got it yesterday but it has shut itself off while listening and/or while pressing a button.

I did the reset but it does not seem to fix it.
 
I ran the updater and did a reformat. If that does not do it, back it goes for a new one. The store can open a new one and test it before I leave, or Apple can eat sh$t and I will get another Dell DJ.

I just want to know if this is common. My DJ needed one reset in nearly 7 months of use.
