Why is it if you leave the keys in reach passed out drunk in bar parking lot

They can give you a DUI saying your moving but in the car sober just getting groceries, car running and in the drivers seat is considered parked :disgust:

Double standard so that they can write a ticket maybe?

The answer to this problem has been stated many times here. Hide the keys outside somewhere where nobody will find them but where you will remember them the next morning. I.e...inside your car's engine compartment or on top of the axle or something.

Well, if you're drunk and in your car, they assume you planned to drive, but you couldn't because you were so god damn wasted. It's not so much the moving part that they're getting you on, it's that you're in the car with intention to move.

But thats my point your parked getting a big item or groceries with intent to move but they give you a parking ticket.

Case 1) You are in the car, with the car running, and can drive at any moment.

Case 2) You are no where near the car.

Both are illegal, but in one case the car is much more likely to move.

not as embarassing as the time you locked your keys outside of your car......

Has this actually happened to you or anyone you know?

IMHO, the least of your/their problems is getting a DUI if you passed out in a bar parking lot with your keys in reach. You should just be glad you're alive. And if you had intended to drive, be thankful that they took your license away, so that next time it wasn't a sucessful drunk drive, who knows what could have happened.

if I were ever in that situation, I'd put the keys in the glove compartment and lock it with the non-chipped key.. which cant start the car... is that good enough?

In PA, you can be dead drunk in your car, but...
1.) You have to be x number of feet from a state owned road.
2.) The keys cannot be in the vehicle.
Believe it or not, if you are drunk in your own motorhome on the side of a road, you are a qualified DUI candidate.
If you are drunk with the keys in your ass, sitting in your vehicle on private property (bar, grocery store, your yard, driveway) you do not qualify.
If you are drunk, with no keys, sitting in someone else's vehicle within x number of feet of a state road, you qualify.

***I don't remember how many feet x is. I'm almost certain it's 60.

Here's one from personal experience...
You and your buddy get drunk. You are driving. He steers while you tune the radio. He swerves off the road. You get stopped.
You both now qualify for a DUI.

No but as I sat waiting for my M-I-L and my wife to come out with big items it dawned on me when my brother got a DUI in the bar parking lot sleeping one off. How he got a ticket for sleeping not moving or car running and if I stayed long enough (5 min or so) and a cop came by he would give me a ticket for parking when my car would be running and me sitting in the drivers seat. Why would they call that parked but sleeping in the back seat with the keys on the floor your considered moving :p
