Why can't I print B&W Text when I am out of color ink?

Is there away around this or has Epson really done something this obnoxous?

This is going to sound stupid, but do you have your printer selected to the black ink cartridge? Or perhaps does your printer use R-G-B cartridges to make black and not have a separate black cartridge? I have seen both of these situations cause problems like yours in the past.
