Why? AA Battery with free windows server 2003?

My friend did this exact thing with some free software he was sent. He sold a single sheet of paper with FREE Windows 2003 Server and 5 seat licenses for over $400.
 
The Software says "Not for resale" on it. So what do you do? You sell something small and insignificant like a paperclip or battery, and say you're throwing in the sw for "free."
 
so this is legal? I have so many NOT FOR RESALE microsoft software. but i sure dont want those MS Lawyers coming after me. I rather eat poop than them coming after me

im surprised no one is selling "packing bubbles" or a "carton box" with free bootleg SQL Server with 100CAL or Office 2003 on it for $300

I'm not sure. I have a copy of Small Business Server 2003 licensed for 5 users that I got for free from MS, and I've been wanting to try "selling" it this way, but I'm afraid of any legal issues.

Think about it, the software is sealed up so right there, you have not seen the license agreements contained within 🙂 The package makes it clear you can not resell the software, however it never makes a mention that you are not allowed to just give it away to someone 🙂 Sure, it is sketchy, but how can they enforce people not to do this?

This is no worse than when NewEgg used to sell you a power adapter cable for $2 with a $2 off discount if you bought it with Windows XP. Like Microsoft intended people to buy adapter cables to qualify as hardware to go with the OS? Let us just call this, "Working the system" 😀
