Well here is the story that just happened to my friend:

Last Wednesday, person A was driving home from school. He had to take this fvck up person B home with him. Well, person B had a cap gun. So like a fvcking idiot, he saw one of his classmates in a car right by him. Well, the kid in the other car thought it was real so he called the cops. Well the cops come out, surround person A's truck and arrest person B. My friend, person A, was not arrested; just talked to. Well, the next day at school our fat b!tch Student Resource Officer has to butt in everyones fvcking business so he took all of the kids out of class, including my friend. Well, they are expelling the kid with the cap gun, it's a given because he was arrested. But my friend (person A) is also getting expelled from school for NOTHING. It doesn't make sense. He didn't hold that cap gun. He didn't aim it at anymore. He didn't get arrested. But they are expelling him from any public school for the rest of his life. WHAT KIND OF JACK SH!T IS THIS?! I am so mad now, he was a computer guy and he had a great future. But now it is fvcked because of this.

So I'm wondering right now, what could he do to fight this? I heard that the kid with the cap gun is getting a lawyer.....

My friend did get expelled. He only told me that and had to go somewhere, I'll give you guys details later. :(

It is sometimes unsettling what gets people expelled or suspended. I hope it's still possible to convince the board not to expel.

Person B had better not come after the other cars occupants with a real gun.

That's why you have to be on the Administration's good side.

I got away with amazing things in school (not things that hurt anyone or hurt the school, but things that were against the rules: in the halls during class, special access rights with computers, I even got into a fight once and was not punished in the slightest despite the school's zero tolerance policy.)

Yea, but this is transferred to the school board because of the case of it. So it's really not up to the administration, but the district people and the cops which blows. :(

person A needs to hire a lawyer. By having a llawyer simply type up a letter to the school eplaining the situation and threatening a lawsuit, many school administrations will just give it rather than get sued. Especially when the situation like this is backed up by a police report.

Just threaten lawsuit, with some actual muscle behind the threat. School Boards are notoriously weak-kneed.

there isn't much person A can do. His parents MIGHT be able to reason with the principle, but I dont think the principle will budge. The board will back up the principle too. A lawsuit probably won't get anywhere either.

Best thing your friend can do is to take his lumps. Admit that he IS guilty by association and learn to choose his friends more carefully.

It's a small price to pay to be safe. You can't be sure if it were a real gun or not from another car, and I wouldn't like someone pointing a gun at me if I didn't know if it was real or not. Anyone can claim it was just a cap gun, or BB gun. It's not fair to the people who are really using a fake gun, but how can the cops be 100% sure you didn't just switch the gun later? This action makes sense to me, and if your friends are innocent, then I'm sorry and hope they make it ok.

That's BS. Get a lawyer, threaten lawsuit. Person A is innocent and his being expelled is crap. This IS a legitimate case for a lawsuit. You can't just kick people out of public schools because they happened to be next to someone else who did something bad.

He didn't know he had a cap gun. I know he wouldn't of taken him home if he knew that i love you had a cap gun.

anyways, threaten with lawsuit, make sure this doesn't go on permanent record. this is complete and utter bull sh!t, and yes, this is reality, and in reality you can sue their ass off.

I am not following all the "he got what he deserved" advice. It's not clear to me if person "B" was actually pointing it at another classmate, or just had it out in the car where someone could see? I can understand (especially if someone was threatened with the gun) the cops being called and the report being filed, but I would not support person "A" being permanently expelled unless he was in on some kind of assault with full knowledge (i.e. more to the story).

It's frightening that so many people seem to accept the form of a police state so willingly!

If your friend really wants to go back to this school, then I would think some kind of lawyer/lawsuit action is in order. Other options might be private school or home education, either of which is really a superior choice for a variety of reasons, good luck.

I love the people saying person a got what he deserved and shoulda picked his friends better. Like you can tell that the person your driving home is going to randomly pull out a cap gun. What stupidity. Person A should not be expelled, he didn't do anything wrong, he wasn't aiding a criminal, he was going home from school.

yea, well my school was so messed up that i got "punished" all the time, but not really because the person would get distracted and i would just walk away :D

but that's not the issue, corruption is not something we should aspire to.

This is no different than riding in a car with someone who decides to run from the cops, when trying to be pulled over. The passenger can be innocent, may even try to get the driver to stop, but both get jail time. Some times the law sucks. Best of luck to your friend, sounds like he's going to have to go to private school.

I guess the question on my mind is this:
If it is as you say and they were driving home from school, i.e. already left the school, how do you get expelled for something like this? The police already dealt with the matter, and I'd say they have trump over the stupid school. Sure, the kid with the cap gun deserves everything the cops throw at him, and maybe the driver should get a good whipping, too. But expelled from school?
I echo mwilding's sentiments regarding zero tolerance.

I have a green plastic squirt gun at home, can I be arrested for that?

If/when I have kids, they will NOT go to public schools. Zero Tolerance is the most retarded thing ever.

I know, plus this WAS NOT on school grounds. They are throwing the excuse that person A had the cap gun in his car when he was in school. But how can they prove it? Person A told me he didn't have it in there, Person B had it in his backpack the whole time. He's gonna get a lawyer...this is really a bunch of bullsh!t. :| I feel so bad for him, his whole life is fvcked up now.
