Who would be at fault? Car accident Question

Firstly this didn't happen, but some lady almost hit me in this situation so I am curious. We were coming up to a stop sign, she puts her right blinker on. I assume she's going right so I get up behind her. I figure she's going to parallel park so I start to go around as I am too close. Without even looking she starts turning super wide and comes within inches of hitting me. Would it be something like 50% 50% fault or something like that?

Thanks,
Kevin

Depends on whether it is 2 lanes or 1. If 2 then she would have crossed into your lane and it would be her fault. If only 1 lane then you have a problem because you should stay behind and not try to go around her while guessing what she will do.

Doh, I left it out I think but since there was no room for her to do anything I went left and tried to get out of her way so she could park.

If it was two lanes it was probably illegal to change lanes so close to the stop sign, usually the lane dividers change to a solid line close to intersections.

Also, you have to take what she actually did into consideration. If she comes to an almost complete stop on the side of the road after signalling to the right, then makes a wide left to go into a driveway without signalling, she is at fault. This exact situation happened to me, where the b!tch basically parked on the right side of the road, didn't signal or anything, and put a huge dent in my passenger's side door when she made the left without signalling. Insurance company said it was 80% hers, 20% mine, which was good enough for her insurance company to have to foot the entire bill.
