Who was at fault in this bump-up?

Edit: The diagram gets completely out of whack when yous submit so disregard it. Dammit...I spent a good five minutes working on that. 😀 Just imagine there are wide aisles inbetween the sections of parking spots. For some reason, they look good when I'm editing but close up together after submitting.

Had a slight bump-up the other day. Not really worth filing a report over but the guy who hit me argued with me for 10 minutes about it not being his fault. I see no possible way it could have been my fault. Who was at fault, based on this description?

Basically, we were both traveling from the back of the grocery store parking lot, down through an aisle of parking spaces, heading towards the front of the store. I was leaving the parking lot from where "Y" is indicated and he was arriving from rear of parking lot but he was in front of me after I pulled out of my spot. He drove all the way to the end of one aisle of spots, where you would then either turn right or left to exit the parking lot, alongside the front of the store. However, when he (shown as "A" on the drawing") got to the end of the aisle, instead of continuing through to the left or right, he put his car in reverse so he could back into the first parking spot at the end of the start of the aisle. This spot is marked as "X" on the drawing. He didn't realize I was behind him as he started to back up and backed right into my front bumper. I just assumed he was exiting that aisle of parking spots so there was no way I had time to back up to avoid him hitting me. And he had his car stereo cranked up and never heard me lay on the horn.

I fail to see how this was my fault but he swore up and down it was. There was no reasoning with this idiot so we just exchanged info and went our separate ways.

You weren't moving, and he backed into you? If so, his fault. Laying on the horn helps your case too.
 
He's 100% at fault, but it'll look bad because you hit the back of his car. If you do go after him, expect him to go for the "ZOMG U HIT ME" stance.

I suggest vigilante justice. 😉

Yeah, he came to a stop at the end of the aisle and so did I, about 5' behind him. He then put his car in reverse and started to turn his steering wheel to the right so he could back into the spot towards the right front of my car.

I added some periods to the diagram so that I could get things spaced out properly. Disregard those but it at least makes the diagram more understandable (I think...lol).
 
His fault. He backed into you. Good luck proving it if he says you hit him. The damage is the same as you rear ending him.

EXACTLY why I didn't call the cops. Even though I knew it wasn't my fault, there were no witnesses. To a cop who shows up later, it would definitely look like I hit him since the collision was on the front end of my car. I knew it would be hard for me to prove it was his fault which is why I'm somewhat glad he agreed to just let it go for the most part.

But there was no way that was my fault despite that idiot arguing it was.
 
report it to your insurance as fast as possible, you don't want him to tell everyone you ran into him from behind.

Sort of. That aisle is longer than I have it depicted in the diagram. I was probably 5-6 spots down the aisle, away from front of store. I was getting ready to pull out of my spot and noticed him coming down the aisle. So as he passed by me, I pulled out. I drove another 10-15' feet before coming to a stop behind his car at the end of the aisle, where you'd normally turn right or left. But that's when he started to back up so he could back into that first spot to his right.
 
You are screwed if he lies since it is automatically your fault if you rear-end someone. You should have got a cop on the scene/gathered a witness since he was argumentitive.

If the accident were in a private parking lot, I know in many instances, the cop won't even determine who's at fault. In this situation, unless the guy had his blinker on, I'd say he was at fault.

And even if he did have his blinker on, he should've looked behind him and waited for you to drive past before he started backing up.

This is why I think driver's licensing exams should be more difficult; so many people have absolutely NO idea what the rules of the road, or even common sense, would dictate in many situations.
 
It's his fault.

However, based on his attitude I would have called the cops. Are you sure he gave you good information?

Plus, if you haven't yet, report the claim NOW.
 
Ok, I didn't read any of your post, and in your picture I saw that it was a grocery store parking lot, but I'll add my $.02 anyway.

Depending on the laws in your state, both of you are "at fault" for the repairs on your own vehicle. In the state of LA, a grocery store parking lot is private property, so you are responsible for the repairs on your own vehicle. A traffic violation ticket is not issued either. Check with the laws of your state.
 
If it happened anywhere near the way you described it, there is no way that it is your fault.
Any time you back into another persons car, you (as he was) are at fault!

He was just being a spoiled brat, like the girl who rear-ended a friend of mine some time back: She didn't even hit her brakes, she was distracted and not watching where she was going.
She got out of her car, calling him names, ranting about how it was his fault, how she was going to sue him, that he was going to have to buy her a brand new car, etc. She kept telling the police officer that it wasn't her fault, and even after the insurance claim was settled (In his favor) she tried suing him!

Today's kids just will not accept responsibility for their own actions, no matter what.

I had better quit now, I just remembered the time a punk (Brothers friend) ran a stop sign and broadsided my wife. Told the Body shop to send me the bill!
 
Yes it as his fault beacuse he his you, however to the best of my knowledge parking lot = no-fault so it irrelevent in terms of insurance... I'd say forget about it.

However if HIS insurance company calls you asking for information, say nothing except for giving them the name of your insurance company.
 
For the love of God, what happened to slot A and tab B? Will they be reunited? Will 'Y' regain his memory? And, will 'X' learn of his love child?

That statement alone will probably stop him in his tracks if your story is true.
Of course you may want to ask the store if they have any video, but not until after you tell him that.
