I am in a bit of a pickle and need some information on returning items when I trade hasn't worked out.

I made a purchase after the seller sent me pictures of the item. When I get the item it is not what was in the photos so I ask for a refund. At first he says he will only give me a partial refund, but later says he will give a full refund. Payment was made via Paypal. So my question is this:

Who ships first?

Neither of us are budging here. He says I have to and I say he needs to pay me first then I would ship the goods. I have logs of all our conversations if there is any interest.

You might me making this harder than it might be, PM me his User name, if hes trusted ill tell you & you should send it first. If he is a n00b then I'm not sure.
 
If the person is a trusted seller here, I think you should ship the item back first. I know that if I sold something to someone and they had a problem with it I would need to inspect the item for myself before I refunded the money.

I had a similar situation, sold a huge collection of cards to someone here on the board, I hadn't looked at them in about 5 years, except to do an inventory of the cards. It turns out one of them was fake, I asked the person to send it back, I inspected the card and refunded the price of the card + shipping + extra for his time and effort.
 
depends on who you are buying from.

I just purchased something from Cryhavoc and i sent first. i have no worries about getting screwed he has great heatware (i only have 2 heh).

Now if it was someone else with crappy heatware NO i would not have sent the money first or so willing. sometimes you need to trust someone
 
Oops... I answered the poll before reading it. I thought it was the typical buyer/seller, should you pay first or get the item first. You should ship first in this case.

sounds reasonable, send it registered or something so you have a record of it when you ship
 
MAKE SURE U GET DC# when u RETURN the ITEM as well or else PP will screw you on the money return, regular insurance will not suffice, almost happened to me

This would have me worried. If he lied to you already by sending you the worng picture more then likely hes going to keep you money, atleast thats how I would take it. It would help if we knew what the item was or vaule of the picture compared to what hardware you was suppose to receive.

If it was me that sent the wrong picture by mistake I WOULD CLEARLY refund the person first its only common since. If in deed evething is like you say.

The item was supposed to be a sealed OS with COA, I got an opened disc w/ no COA.

WTF, hell yes in that case he should be paying you back first. How hard is it to realize that you've "accidentally" opened the software and took the COA out of it?
