Who owns this logo?

Let's say that there was a website around 6 years ago that had a logo that I liked for a company that I was developing.

The other website no longer exists and I purchased the domain.

I can't find the previous owners of the domain or website.

Can I use their logo on my site?

How much will they sue me for?:)

EDIT: added the word "find"

More info: I am talking about having the logo re-created nearly exactly as theirs was. I made a screen shot of it about 7 years ago.

I think you need to find the company or person in good faith and have it documented somehow so that you don't get sued.

There are probably ledgers or court documents or state documents saying who owns the company or who the lawyer was.

You can't them? They can sue you for whatever they want.. how in the hell should we know?

Just make one similar to it but different.

Depends on who made the logo and how up they are on copyrights. Also it depends on how successful your company is. Imagine what Google would have to pay if it was found that they had jacked a logo.

It was just some fly-by-night website (like the junk I do) that was up for a year to two then they let their domain expire and then I bought the lame domain name.

I believe I have made a good faith attempt to find the ex-site owners.

When I get sued I can tell the judge, "I asked the dudes on ATOT."

Let's put it this way, if these people can get away with this logo link which has an uncanny resemblance to some other existing website's logo, I should be fine.
