At least, it was from a sperm bank. I've read stories of a "surprise <insert race not of the father or mother>" baby and the mother claiming it is a miracle! I even read one one where a lady gave birth to "twins", one white and one black. Medically, it wasn't a miracle, just an anomaly that she had two eggs fertilized by two different "sperm donors" in a short period of time. Of course, her idiot husband believed her that it was a miracle...

DNA test?

Anyway, back to the point at hand, the lady does have a case on the merits that the facility screwed up and sent the wrong donor. She has no merits otherwise. This is a frivolous lawsuit - she just wants a payday.

Is it legal to discriminate based on race of the sperm donor? Has that been challenged in court at all?

I don't think that's even in play here.

- Lady requested specific criteria.
- Facility matched donor records with Vial #380.
- Employee at facility misread and shipped Vial #330.

The facility is most likely liable for improperly handling of the product. Because the "consumer" has the (blech) right to discriminate in choosing features about the donor profile, and race happens to be one of those, then one would have to assume that the company would be liable for the outcome.

However I don't think that the company should be held liable beyond damages for the delivered product: The Sperm.

This will probably be a very sticky situation. :sneaky:

I think the company should be liable if what they provided was not what the customer agreed to pay for, however damages should have nothing to do with the fact her friends are racist rednecks and she lives in a black-hating town.

Wrong. Nature over nurture baby. IQ is highly hereditary. However, getting into elite schools has honestly a lot to do with how much money your parents have.

If you are going to say I am wrong, your following statements should not agree with exactly what I said. "Highly educated" has little to do with IQ and more to do with environment.

I suppose having the fortitude to pursue a degree in a very elite school could indicate a kind of dogged determination that is at least partially genetic. Anyway, not knowing exactly what is genetic and what isn't, you probably want to take every positive aspect in a donor you can get.

There is a scientific term for this. Back then there was no DNA test and many people refused to believe that "black blood" was in every person. So the conclusion was his wife cheated on him, even though that was not the case.

Legal proceedings take time. You file a lawsuit, you spend years negotiating, and it's not until you get a court date that the stuff makes the news.

Orrrr... she was sitting around relaying this funny story about how she ended up having an African-American baby even though she ordered up a #1 with a medium fries and a Sprite, and one of her family members/friends/acquaintances said something like, "Heh, you should sue them for that!"

Really? My mom was a B student in high school, and my Dad was a C student who then joined the army.

Then I came along and ended up getting straight A's and earning a degree in engineering. So0o0o I must have gotten grandpappi's smarts then.

Black hair is curly etc....

I don't know if you know but there are barber shops that specialize in black hair etc... They generally have all black patrons. Blacks have their own hair styles etc.... However, I've seen blacks in white barber shops and vise-versa (though it's rare).

Some barber shops will use hair straighteners etc... which may not be avail at shops that have predominately white customers.

Is there any scientific evidence of atavism happening in regards to skin color and other racial traits? I can only find things like vestigial tails and such. There doesn't seem to be any real evidence Laing was a product of atavism other than her mother claiming to have never been unfaithful.

They don't discriminate. This is how it works. You fill out a bunch of shit and they perform test on you and your sperm. They can reject you for things like bad sperm, disease etc... They put you in a profile and those women discriminate against you.

So they won't tell you in your face "there is no way if fuck a women is going to want your sperm". But you may never get a phone call after donation. I believe they may bank your sperm initially (to give you the impression that they may donate), but sperm doesn't survive long outside the body, even with refrigeration.

If you have those "good attributes" (i mentioned in my first post). They expect to get phone calls on the reg. In addition you will be treated with a higher level of respect (because you make them money!!!!).
