If you're trying to burn some audio files that are encrypted and enforced via DRM then you need software that can decrypt them and that will require it do whatever checks the DRM requires. You can't just "not check" to get around it, that would make the whole thing pretty pointless.
I assumed the buring software has somethign in it which looks for the DRM, and then refuses to burn if it is detected. I thought if I could make it burn the files as data, it would work.

Burning as data will work, but the drm is attached directly to the file IIRC. Usually, if you burn an audio CD through whatever program that you got the DRM-ed music from, it will strip it. So if you bought music through the itunes store, for example, and then burn it as audio with itunes, it will strip the drm.

Most burning software doesn't have any DRM checks, except for the ones that are music players that double as burners like WMP or iTunes. Burning them as data will get you a backup but you'll still need the DRM key to use them so they'll be worthless on any other machine. Unless you can backup/restore your key onto the destination machine.
