When is it time to ask for a refund?

Purchased $800 in truck parts on March 8th. One part is large and could only be reasonably shipped via USPS Parcel Post which can take a long time to where I live (Alaska) so we're not focusing on this part.

The other part was to be shipped Priority Mail (3-5 days from date of shipment to arrive). The gentleman who took my order said it was in-stock and ready to be shipped.

March 22nd still no sign of package. I contact the vendor and he provides a Delivery Confirmation # showing that, "Electronic Information Received" on March 15th. No information pertaining to the package actually shipping. Vendor states if I don't receive it soon let him know and he'll put a trace on it for me.

March 26th and still no sign. I contact the vendor via email letting him know and if we could place a trace on the package. No response in three days so I email his associate asking for help. He tells me the package was shipped when "John said it shipped" and blame USPS tracking. He also said "John" would call me the next day so we can talk about it.

I know USPS tracking isn't very good, but even if it wasn't a package mailed Priority Mail has never taken 18 days to reach Alaska, especially from the West Coast. I ask the associate, and cc "John" as well asking if we could find out if it was in fact shipped Priority or if it was shipped Parcel Post. Four days later and no response, "John" never called either.

Is it time to ask for a refund w/ the possibilitiy of getting my CC company involved? I'm almost certain that the package was either shipped Parcel Post or has not even been shipped yet. If I could receive a hard & decisive answer from these guys on the true shipping status I wouldn't even be thinking of a refund, but, it hasn't happened and I'm on my last nerve...but I don't want to overreact, which is why I'm seeking outside advice.

Cliffs-
- Purchased $800 in parts on 03/08/07
- Seller claims part that can be shipped fast was shipped Priority Mail on 03/15/07. Delivery Confirmation info does not state any actual shipping information.
- Asked to trace package on 03/26/07, no response from owner (who took my order)
- Spoke with associate on 03/29/07 who said owner would contact me, still no contact.
- As of 04/02/07, still no sign of package
- Time for ask for refund w/ possibility of having to get my credit card co. involved???

Stop the order and the charge on the card. If you do get the parts, pay for what does arrive. That should get their attention.

What I was thinking of doing was giving them until the end of the week to get me some answers OR give me a refund. If neither one of those happen I will contact my credit card company.

What type of business did you order from? eBay store / Amazon seller type? Full-scale business?

I think you are being reasonable. I think it is appropriate to call the credit card company and get the process started.

I ordered from a web-front store. They have an ebay store as well.

They are also sponsors of a truck-specific website forum that I browse, which is where I found them.

Anyone else care to chime in before I hit the "send button".

Here's a copy of my email to them as well, is it too harsh?

John,

It's now April 2nd, nearly one month since I placed the order of the Volant Intake and Exhaust from you and your store (March 8). I have yet to see the intake that you claim was shipped (Priority Mail) on March 15th.

Priority Mail takes, on average, 3-5 business days to arrive. If the intake was shipped via Priority Mail, as you claim it was, then, based on the average, the intake would have arrived no later than March 22nd.

However, let's say that instead of shipping on the 15th, a Thursday, it shipped on the 19th, a Monday. Even though we receive mail on Saturdays, let's not count Saturdays in our timetable. Based on the average, the intake would have arrived no later than the 26th of March.

Today is April 2nd John, 18 days, or 11 business days (not counting Saturdays, which again, we receive USPS mail on) since you claim the intake was shipped. Out of the hundreds of packages that I have sent and received via Priority Mail I have yet to see a package take this long.

Three scenarios have occurred. 1. The intake has not shipped. 2. The intake has shipped but was shipped Parcel Post and not Priority Mail, which we had agreed up and that I paid for. 3. The intake is lost in transit.

However, my requests for information have not been returned. I understand you are busy but, frankly, I expect answers to my requests as a paying customer. I had to go bug one of your employees for help due to your inability to contact me.

At this point, I am going to request a refund for the full purchase price of $800. I will give you until the end of the business week, April 6th 2007 to see a refund transaction back on my credit card, or, at the very least, acknowledgement that a refund is being processed. If you do not issue a refund I will contact my credit card company and you can deal with them.

I'm sorry it has come to this but my patience has been exhausted.

I guess it is a good thing that you didn't do much ordering from catalogs when 6-8 weeks shipping was standard.

If you are this angry with the company, I would suggest you get your money back and move on to the next company. But your letter could/should be shortened. They can do math, they know that a part ordered 4 weeks ago priorty mail should have arrived by now (assuming they claimed it was in stock and would be shipped immediately).

The CC refund is a hassle and you have to show that you tried in good faith to get it resolved with the company. Make your letter shorter and nicer and you'll meet that criteria. Look at the back of a CC statement and it'll give you the EXACT text that is required (federal law gives reasons that a CC must give your money back, you might as well make your letter state that reason clearly so that federal law backs you up). It'll be something like "I didn't receive the product as described." Plain and simple.

That's not the point bud, if the vendor said to expect it in 6-8 weeks I wouldn't be even bothering with all this right now. The other part (an exhaust) is going to take 6-8 weeks to get up here....and that's cool. However, I was told this part (an intake) was in-stock, would be shipped the next day, and be shipped Priority Mail.

They claim it was shipped a week later (no biggie), but the Delivery Confirmation info doesn't ad up, and it's been nearly three weeks since they did claim it was shipped...Priority Mail.

Yeah, I've had to do a CC refund before, it is a pain in the rear but I don't really know what else to do?

I'll shorten up the letter, thanks!!!!

I still haven't sent the email off yet...I really would like to hold out some hope but this is getting ridiculous.
