The only time we don't ask for people to sign is if they're going to the pokey.
 
i got a speeding ticket in TN and the cop made me put my keys on the top of the car. then she took them and would not give them back unless i signed.

so i signed the ticket and underneath i wrote: SIGNED UNDER DURESS.

and boy of boy did it piss the judge off. he said that if she had put a gun to my head, that would be considered duress..NOT holding my keys. He said that it was an abuse against the police and found me guilty of the speeding ticket without even letting me tell my side.

Probably because you need to look at the meaning of duress. That is NOT duress. You broke the law. The law in TN states that you must sign the ticket as proof that you have 1. Received the ticket 2. Understand the citation against you 3. Will appear in court or pay the fine.

Actually, I think they have the right to take you to jail if you do not sign.

Duress is coercion illegally applied. The cop did nothing like that.

Ha! you are correct. But at the time, I did not understand that. I was under the impression... wrongly so... that by signing the ticket, I was admitting to guilt. And I am kinda a 'sign nothing' sorta person. So, i did not want to sign and she refused to give me my keys back. And i thought that since i did not WANT to sign, and she would not give me my keys if i did not sign, then it was ok to put that there.

Lesson learned.

I've been pulled over so many times by the TN cops that I have the ticket and laws memorized 🙂

Not really, but it sure feels that way!

I'm REALLY surprised they made you take the keys out of the car though. I do not agree with that (unless he felt you were going to be trouble). I've never had them ask me to do that. Very odd. Maybe it's because you were out of state? I dunno, but you don't seem like that sort of trouble, lol.

Is this different from state to state? I just assumed all states made you sign. I've had tickets in FL, GA and TN. I've had to sign all tickets. It's their way of proving you understood what happened and you are who you are.
