When doing an insurance claim, does the insurance company have to give you new parts?

Someone rear ended me and damage my bumper cover and metal bumper. The insurance agency wrote me a cheque and i went to a toyota dealership to get it fixed. However, they would not do it because the insurance company gave me money for 'used' parts only...


Is this right? Or are they supposed to give me money for brand new parts? The company is allstate btw.

Depends on the policy and any riders.

Refurbished/Reconditioned is pretty standard on most policies.

Doesn't sound right to me.

As far as i've been told, you may have to request OEM parts, thats about it.

Never heard of having to get used parts at the dump.

most states allow this. They just have to cover turning that used part to "like" condition. So if it has to be stripped and so forth that is covered.

My policy is for OEM parts, but I have in the past allowed used parts to be put on, with the condition that any amount saved by the insurance company comes off of my dedcutible.
