Do you mean the RIAA? Unless I missed something KAZAA isn't taking anyone to court.

Yes, it is, for now. It's just a matter of time before the British Phonographic Association (or whatever the UK version of the RIAA is) takes British Kazaa users to court or the RIAA gets the power to do it to British users.
