What's the deal when it comes to selling a microsoft operating system?

Can I sell my used copy of windows? What if the disk breaks but i still have a copy & cd key can i sell it then? What is "legal" and what isn't? Are the laws the same regarding videogames and or other software?

If it's an OEM version, then you're not supposed to sell it. IF it's retail, then it's fine to sell, but you would have to uninstall it from the current PC that is using the serial number.

Let's say you only have the serial & backup. How do you tell the difference between OEM & Retail??
