So we just built a house in an established sub division. We were one of the last remaining houses to build so as anyone who is in my position can imagine a lot of the other neighbors used the lot to dump crap they didn't want in theirs...rocks, clippings, brush...

No worries so far...until we started getting ready to get a yard installed. Our back yard has a retention pond that is shared by 4 other houses...we share 2/3's of it as the other 1/3 is undeveloped.

When we bought the lot I noticed that the next door neighbor had planted a garden at the back corner of our lots at the point that they come together...but it technically looks like it is on the back right corner of our lot.

I didn't think anything of it since it was undeveloped...

so fast forward to today and I see him out their planting in it and I am kind of like WTF, we are about to get going on our lawn and this guy is planting stuff.

I nicely go over to him and ask him about it when he is out in the garden. He kindly informs me that he is planting on the edge of the 'out lot' that isn't owned by anyone (neither him or me) and is going to be maintained by a third party (basically mowing). Now everyone else treats it as part of THEIR yard and mows up to the edge of the out lot so it 'appears to be' part of their yard but technically isn't.

I then ask him if there is a problem with planting a garden their and he smiles and says 'only if someone complains'.

The guy is on the town board I find out and appears to have all the right connections, his wife is the treasure of the board.

I could give a shit if he plants a garden...but do it on the out lot that is behind HIS house and not the one that adjoins to mine.

I am kind of annoyed that this older gent doesn't want to crap up his maintained lawn and wants to plant on my side...my wife now wants to plant one on HIS side in the out lot just to piss him off...

What are your thoughts?

unowned property past property line is unowned. anyone can do what they want.

you could dig up his garden and put trees there.. noone can say anything.

Planting a garden is "crapping things up"? Personally, I wouldn't care. The only issue is if someone "in power" wants use that property. He'll then lose the garden, but that should be understood.

Uh... isn't it obvious? Let him garden away and when it comes time to harvest go nuts on that shit. It's not like it's his property.

I agree with the comments that it is unowned and can be done with as others please as long as someone doesn't disagree. We wanted to also put in a small garden some place on our own yard...I hadn't thought about doing it on the out lot and if we did I would have assumed to put it behind our own home and the neighbor's out lot.

I find it a little annoying considering the guy has over an acre and a half lot and chooses to put it on our side when he could have chose any point behind his house within a 250 ft radius across the out lot.

Ha...I was about to put the little ducklings and the momma duck in the picture but chose against it because they looked like little turds and felt it would derail this already worthless mini rant!

If it's an "anything goes" area I'd use it to dump my rocks, gravel, weed killer etc. He should get the message.

Put your garden on "his side" of the unused area :^D

Whatever you do, don't let it bother you. You got what you paid for, and if your neighbor gets a little more, it isn't a big deal in the end :^)

I think your neighbor needs to share his crops with you.

Maybe go in with your neighbor with a community garden? Build a rabbit cope, and use the manure for fertilizer.

I didn't know how else to start off but to explain we haven't been living here for an extended period of time (about 2 months)...so it isn't an on going thing (year after year)...

Did you bring this point up in your convo? If not, why not?

Anyway, choose your battles. Making a personal enemy out of such a "connected" guy (who may not otherwise be an ass at all) over such a petty thing, and one that you do not have a fully legitimate right to bitch about seems . . . ill advised.

Next full moon, get out there and pee all along its border while grunting and pounding your naked, warpaint-smeared chest. It might make you feel better. ;)

To be honest it would piss me off a little. I think I would try to gently suggest that next year he should plant it behind his property and not mine.

Go plant pumpkins and tomatoes behind his lot, and let the vines run all over the place. It will make his backyard look like a mess, and I'm sure he will get the picture. If he asks you to move it, say you wound love to, but he has already taken up the land behind your lot. :p

Or go water his plants with plant killer for a few nights while he is sleeping. The problem will take care of itself.

Wow, a clever ADD remark. However, if I had ADD I wouldn't haven't lasted to the end of your tale and therefore would not have been able to tell whether detrius was relevant to a complaint about a neighbor's garden on onclaimed land.

Like people have said, if it's ffa then see if you can both use the land for a bigger garden and if he doesn't want to share or it looks ugly do as you want and make it look nice for you while ruining his work.

He started it so you should finish it. ;)

But seriously simply tell him you planned on planting there since it's behind your lot and to move the stuff by his if you don't want to share it and tell him if he doesn't you will take care of it and if he complains to get them both fired off the board.
