If your CEO (the King of your company) ask you to notarize a person that will not be present during the notarization, and from what you learned that is illegal, what would you do?

Would you stab someone, set the building on fire, steal money, etc if the CEO asked you to?

I would say, "I'm sorry, I'm not allowed to do that by law. I'm sure you understand."

I would refuse citing that is illegal.

One company i worked for wanted me to research sending out mass faxes (fax spam). I organized documentation that this was illegal and i refused to do it. They pressed, i went to the company lawyer and she squashed it. I got flack for going to the company lawyer instead of the department director, but i told her that i had already done that and no one was listening, so i figured the company lawyer was the next best person to go to since no one would listen to me.

What's your legal liability if you know it's illegal, tell them so, but feel that you are being compelled to do it in order to keep your job?

Actually the company lawyer might be a good idea. Regardless, if the boss is an ass he can make life miserable for you at the office, but in that case i guess it's a big sign that says "move on". The ceo has done similar things like that in the past, so i guess it's not a blessing when my wife obtained the notary cert.

Do you have anything in writing? emails or anything telling you to do it, and advising that it is illegal? If you do...print out copies or send the emails to your home email to keep just in case. Never hurts.

Make sure to document it with HR if he does anything. Harassment and retaliation firing is a big no no.

I dont care if he's Jesus Christ himself. You tell him it's illegal. Why should you compromise your integrity and possibly your career?

Well its a criminal offense for the notary, which would trump the civil proceedings he could bring for job loss. Not a good trade...
