If someone was hitting you in the streets... and then you defended yourself.. but you accidently killed him in the fight... what are the consequences?

edit: yes i know it's self defense, but is there no consquences for killing him because of self defense?

If you were cornered in a dead end alley, and the guy had a knife pulled and you pulled out your gun and shot him, you might still get in trouble. Because just showing the gun should have been enough to get him to stop. They would have wanted you to hold him at gun point and wait for a cop!

That said, the same thing goes for fighting. If you are cornered in an alley and this guy has no weapon on him, and you get in a brawl, having him unconscious on the ground and kicking him until he died would get you in trouble.

If he had a knife and you didn't, and in the brawl you turned the knife around and stabbed HIM, that would be just.

There are weird rules that apply in self defense. I know most of the concealed handgun rules.

I'm sorry, but that is such a load of bullsh!t. You do *not* flash a gun as a means of deterrance. You don't pull a gun unless you are going to use it. You would get in trouble for brandishing a weapon, not for using it in self defense.

That is what I learned when I go my carry permit

If you pull it.. it better be to use it... and if you use it... shoot to kill.
Pulling a gun to scare someone brings big trouble.

Exactly. If you pull a gun and don't use it, you can be charged with assault with a deadly weapon. If you *do* use it, you can be charged with discharging a firearm within city limits, endagering the public, criminal neglegence (spelling?), assault with a deadly weapon, battery, and if you kill the guy, either manslaughter or murder.

Take your pick, but be damned sure that you know what you're doing if you decide that you need to remove your firearm from your holster.
