Attempted robbery is still a crime and I think a jury might actually convict a guy for doing that. Beyond a reasonable doubt.....it's a tough defense when you walked into a convenience store dressed like that.

But it isn't attempted robbery. He never asked for any money, nor did he threaten to steal anything.

There was some idiot DJ at a radio station in Austin, Tx that did something like that a few years ago. Got arrested and charged with making a terroristic threat or some other nonsense like that. I don't remember what happened to him though.

That was the question in my OP. Personally, the panty-hose was a little over-the-top because no one wears that on their head.

I know a couple of guys that basically did just that. The went into a store and walked back to where the panty hose were. They opened up a couple of packages then put them over their heads. At that point they RAN to the check out lane. One guy kept running while the other one slammed down enough money to pay for the panty hose on the checkout line and then took off out of the front door. The cashier was *stunned* to say the least, but nothing happened to them.

Edit: Not that I would ever try that.
